How Foreclosure Works in Maryland
Maryland is a non-judicial foreclosure state, meaning the lender can foreclose without going to court, but there are still protection points and timelines you need to know.
Missed Payment
The clock starts 15 days after your first missed payment. Lenders typically do not file until you are 90 to 120 days delinquent. During this time, call your lender and ask about loss mitigation options: forbearance, loan modification, or repayment plans.
Notice of Intent to Foreclose
At 90 days past due, your lender sends a notice. This is your warning period. In Maryland, you must receive at least 45 days' notice before a foreclosure sale can be scheduled.
Published Notice of Sale
The lender publishes a notice of the foreclosure sale in a local newspaper for 3 consecutive weeks. The sale date is set no fewer than 10 days after the last publication.
Foreclosure Sale
The property is auctioned on the courthouse steps. But you still have time. In Maryland, you can redeem your home (pay the full debt) any time before the sale is ratified by the court.
Post-Sale Ratification
After the sale, the court holds a hearing to ratify it. You can file exceptions before this hearing. Once ratified, you lose the property.
